Yoga Beyond The Studio LLC, a California limited liability company, and Yoga Beyond The Studio Retreats LLC, a California limited liability company (collectively, "Yoga Beyond The Studio," "we," "us," or "our"), are committed to protecting the privacy of our users ("you" or "your"). This Privacy Policy will inform you about the nature of the information that we collect and how we use, protect, and sometimes disclose such information. This Privacy Policy applies to all services offered by Yoga Beyond The Studio LLC and Yoga Beyond The Studio Retreats LLC, including our websites, classes, and retreats.

Amendments and Updates

This Privacy Policy (or any part of it) is subject to amendment or change at any time without prior notice. All modifications take effect immediately upon posting on our website ("Our Website"). We encourage you to review this page periodically to see any updates to our Privacy Policy.

Privacy of Children

We comply with the Children’s Online Privacy Protection Act of 1998 (COPPA). We do not knowingly collect personal information directly from children under thirteen (13) years of age through Our Website. If you are under eighteen (18), you are prohibited from using Our Website independently, as outlined in our Terms of Service (incorporated herein by reference).

However, if a child under thirteen is registered by a parent or legal guardian to participate in a class or retreat, we may collect limited personal information about the child (such as name, age, and relevant health or accommodation needs) strictly for the purpose of delivering the service. This information is collected only with verifiable parental consent, typically through the parent or guardian's execution of a required waiver or registration form on the child’s behalf.

If we become aware that we have collected personal information directly from a child under thirteen without appropriate parental consent, we will promptly delete that information. If you believe such a situation has occurred, please contact us immediately at info@yogabeyondthestudio.com.

Collection of Information

We collect personally identifiable information, including but not limited to your name, postal address, IP address (and its geographical location), phone number, and email address, when you submit this information to us or when you interact with Our Website. In order to purchase any services on Our Website, you may be required to submit certain contact and billing information (such as name, email, phone number, shipping and billing address) to our third-party payment processor. Payment information (e.g., credit card or bank account details) is collected and stored by the payment processor directly; we do not receive your sensitive payment details. The payment processor will transmit your contact information to us so that we can fulfill your order or booking. We will store your contact information and may use it to contact you with future news, offers, or updates, unless you choose to opt out as described below.

Opt-In and Opt-Out

We only send promotional communications (newsletters, advertisements, survey requests, or updates) to users who have affirmatively opted in to receive such information. By purchasing a product or service on Our Website (including signing up for classes or retreats), you consent to receive these communications. If you no longer wish to receive such information, you may change your preferences in your user account settings or unsubscribe using the link provided in our emails. You may also opt out at any time by contacting us at info@yogabeyondthestudio.com.

You may receive mail or email from us about new products, services, or upcoming events. If you do not wish to receive these, please let us know by sending an email request to info@yogabeyondthestudio.com.

Collection and Use of Non-Personal Information

In addition to the personal information described above, when you visit pages on Our Website we may collect certain non-personal information about your visit. This data may include, for example, the type of browser you are using, your device’s operating system, your Internet Service Provider’s domain name, and your device’s Internet Protocol (IP) address. We may collect this information directly or use a third party to collect it on our behalf. We generally use this information to improve the layout, content, and user experience of Our Website, to analyze site usage, and to enhance our services. This information may also be used to provide you with tailored advertisements and marketing messages.

We currently use Hotjar to better understand our users’ needs and to optimize our service and user experience. Hotjar is a technology service that helps us analyze user behavior (e.g., how much time users spend on which pages, which links they click, etc.) in order to improve Our Website. Hotjar uses cookies and other technologies to collect data on users’ behavior and devices (including device IP address (captured and stored in anonymized form only), device type and screen size, browser information, geographic location (country only), and preferred language). Hotjar stores this information in a pseudonymized user profile. Neither Hotjar nor Yoga Beyond The Studio will ever use this information to identify individual users or to match it with additional data on an individual user. For further details, please see Hotjar’s privacy policy by clicking on this link. You can opt out of Hotjar’s data collection on Our Website by following Hotjar’s opt-out instructions here.

Collection and Use of Cookies

Cookies are small text files that are placed on your device’s hard drive by a web page server. We use cookies to understand and save your preferences for future visits, keep you logged in during a session, and aggregate data about site traffic and site interactions. Cookies help us to improve Our Website and deliver a better and more personalized service. Our cookies do not compromise your privacy or harm your computer. You have the ability to accept or decline cookies using your web browser settings; however, please note that if you disable cookies, some features of Our Website may not function properly.

Advertising and Marketing Technologies

We use various advertising and marketing technologies to track user activity on Our Website and to deliver tailored advertising on third-party platforms. This process is often referred to as “remarketing” or “retargeting.” While we do not share personally identifiable information in this process, our third-party advertising partners may collect certain data about your visits to Our Website via cookies and similar technologies and use that information to serve you relevant ads on other sites or platforms. These partners may collect device identifiers, browsing information, and other online activity data through cookies or pixel tags on our site. Please note that we do not control the data practices of these third-party partners beyond the agreements we have with them.

Facebook

We may use Facebook “visitor action pixels” (Facebook Pixel) on Our Website for marketing and analytics purposes. The Facebook Pixel allows us to track actions taken by users after they are redirected to Our Website from a Facebook advertisement. This technology helps us measure the effectiveness of our Facebook ads by understanding what actions users take on Our Website. The data collected via the Facebook Pixel is anonymized to us (we cannot see the personal information of individual users). However, Facebook may use the collected information for its own advertising purposes, in accordance with Facebook’s data policy. This may result in ads being served to you on Facebook or other websites based on your browsing behavior on Our Website. You can adjust your Facebook privacy and ad settings to control the ads you see. For more information on advertising privacy and preferences on Facebook, visit your Facebook account Ad Settings.

Google

We use Google advertising services such as Google Ads Remarketing and Google Analytics for Display Advertising. These services employ cookies and similar tracking technologies to understand your activities on Our Website and other websites, and to display targeted ads to you via Google’s advertising network. Through these technologies, Google may collect information such as your IP address, browser type, and pages visited. We do not have access to personal data through this process, but the data may be used by Google to show you advertisements based on your past visits to Our Website. You can learn more about how Google uses data in advertising and how to opt out of personalized ads by visiting Google’s Ads Settings or Google’s other online resources on privacy.

AdRoll

We may also use AdRoll (a retargeting and prospecting platform) to serve ads to you on other websites after you have visited Our Website. AdRoll uses cookies and similar technologies to track your browsing activity across sites and show you relevant ads. Information about AdRoll’s data practices (including how you can opt out of its targeted ads) can be found in AdRoll’s privacy policy here.

Third Party Links

Our Website may contain links to third-party websites (for example, partners, advertisers, or social media sites). Please note that we do not control and are not responsible for the content or privacy practices of those other websites. If you choose to follow a link to any third-party website, we encourage you to review the privacy policy of that site, as this Privacy Policy will not apply to your use of any third-party site.

Third-Party Service Providers

Identity Verification (Yoti)

We may use the Yoti identity verification service (“Yoti”) to confirm the identities or ages of our users for certain services (for example, verifying participants for retreats or other programs). Yoti is a third-party provider, and we do not own or control the Yoti platform. If you choose to verify your identity through Yoti as part of our services, you acknowledge that you have read, understood, and agreed to Yoti’s Privacy Policy (available at https://www.yoti.com/privacy). Any personal data you provide to Yoti (such as an identification document or biometric data for verification) will be collected and processed by Yoti in accordance with Yoti’s privacy practices. We receive only the verification results or status (e.g., confirmation that your identity or age is verified) from Yoti and do not receive the detailed personal information you provide to Yoti for verification.

Retreat Bookings (WeTravel)

All trip bookings and related payments are processed through our third-party partner WeTravel. WeTravel is an independent booking platform that we use to manage retreat reservations, itineraries, and payments. While retreat information may be available on Our Website, when you decide to book a retreat you will be directed to WeTravel’s platform. We do not own or control the WeTravel website, and any personal information you provide during the booking process is subject to WeTravel’s own privacy policy and terms. By booking a retreat via WeTravel, you acknowledge that you have read, understood, and agreed to WeTravel’s Privacy Policy (available at https://www.wetravel.com/privacy). We may receive certain information about your booking from WeTravel (such as your name, contact information, payment details, and trip details) to help us administer the retreat, and sensitive payment information and other details you provide to WeTravel are handled in accordance with WeTravel’s privacy practices.

Email Marketing Communications

We use third-party email service providers, including Mailchimp and Sender.net, to manage our newsletter subscriptions and marketing email campaigns. If you sign up for our newsletter or other marketing communications, the contact information you provide (such as your name and email address) may be stored and processed by these providers on our behalf. Mailchimp and Sender.net may also collect certain analytics data (for example, email open rates and link clicks) to help us understand the effectiveness of our communications. Any personal data processed by these email services will be handled in accordance with their respective privacy policies. For more information, please review Mailchimp’s data privacy information and the Sender.net Privacy Policy. We do not share your email address or personal information with any other third parties for marketing purposes, and you can unsubscribe from our mailing list at any time by clicking the unsubscribe link in our emails or by contacting us.

Disclosure of Information

We use your personal and non-personal information only as described in this Privacy Policy, except in the following special circumstances where disclosure may be required:

  1. Compliance with Laws: We may disclose information if required to comply with applicable laws or regulations, or in response to lawful requests by public authorities (for example, to meet national security or law enforcement requirements), subpoenas, or court orders.
  2. Protecting Our Website and Users: If there is any unlawful or unauthorized access to or use of Our Website, or we need to investigate and defend against legal threats or prevent harm, we may disclose information as necessary to protect the rights, property, and safety of our business, our users, or others (for example, to prevent fraud or enforce our Terms of Service).
  3. Public Forums: If you choose to submit or post information in public areas of Our Website or on our social media pages (such as reviews, comments, or other content), that information will be visible to others. We are not responsible for any third-party use or appropriation of information you voluntarily share in public forums.
  4. Business Transfers: If we undergo a business transaction such as a merger, acquisition, or sale of all or part of Yoga Beyond The Studio (or of Our Website or assets), your personal information may be among the assets transferred to the new owner. In such cases, we will require the acquiring party to uphold the privacy commitments we have made in this Privacy Policy.

Ownership and Use of Posted Information

Any communication or material that you transmit to us for public posting on the internet (including any data, questions, comments, or other content you submit in public areas of Our Website, blogs, or social media pages) will be treated as non-confidential and non-proprietary to you. By submitting such content, you grant us and our affiliates a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display that content for any purpose, whether commercial or non-commercial. You retain ownership of any intellectual property rights in the content you submit, and this Privacy Policy does not limit your rights in such content. However, we reserve the right to remove or refuse to post any of your submissions at our discretion. Additional terms regarding user submissions may be outlined in our Terms of Service.

Disclosure to Third Party Yoga Teachers

One of the primary purposes of Our Website is to connect yoga students with independent third party yoga instructors ("Third Party Teachers"). If you request a yoga session through Our Website, certain relevant information about your request (such as the type of class you want, the number of participants, and the general location where you’d like to hold the session) will be visible to eligible Third Party Teachers so they can respond to your inquiry. Once you have confirmed a session with a particular Third Party Teacher, we will share the necessary personal information with that instructor to coordinate the session—typically your name and the specific location and time of the session. We require via contract that all Third Party Teachers (and their agents or employees with access to student information) keep your personal information confidential and use it only for the purposes of providing their services. Apart from the information needed to facilitate your requested sessions, we will not share additional personal information with Third Party Teachers unless we have your consent or another lawful basis to do so. (For example, we never share your payment information with Third Party Teachers.)

California Privacy Rights

If you are a resident of California, you are entitled to certain rights over your personal information under the California Consumer Privacy Act ("CCPA") and the California Privacy Rights Act ("CPRA"). These rights include:

  • Right to Know: You have the right to request that we disclose what personal information we collect, use, disclose, and sell (if applicable) about you. This includes the categories of personal information we have collected, the categories of sources from which the information was collected, the business or commercial purpose for collecting or sharing the information, the categories of third parties with whom we share personal information, and the specific pieces of personal information we hold about you.
  • Right to Delete: You have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, if the information is necessary to complete a transaction or comply with a legal obligation).
  • Right to Correct: You have the right to request that we correct any inaccurate personal information that we maintain about you.
  • Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale of your personal information by us, or the sharing of your personal information for cross-context behavioral advertising. Note that Yoga Beyond The Studio does not sell your personal information for monetary consideration. We also do not share personal information for targeted advertising except as described in this Privacy Policy (for example, through cookies used for advertising as discussed above). If you direct us to stop "selling" or "sharing" your information as defined under California law, we will honor your request.
  • Right to Limit Use of Sensitive Personal Information: If we collect any information that is considered "sensitive personal information" under California law (for example, government-issued identification numbers or precise geolocation), you have the right to direct us to limit the use or disclosure of that information to the purposes authorized by law.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your California privacy rights. This means we will not deny you services, charge you different prices, or provide a different level of service because you exercised your rights under the CCPA/CPRA.

To exercise any of your California privacy rights, please contact us by email at info@yogabeyondthestudio.com or by using the contact information provided on Our Website. Please include "California Privacy Rights" in your communication and describe the nature of your request. We may need to verify your identity and residency before processing certain requests, which may involve requesting additional information from you to confirm your identity. You may also designate an authorized agent to make a request on your behalf, in which case we will take steps to verify the agent’s authority and your identity.

We aim to respond to a verifiable consumer request within the timeframe required by law (generally within 45 days). If we require more time to respond, we will inform you of the reason and extension period in writing.
